These Rules, Terms and Conditions govern participation at Spin Casino and bind every player who takes part, including New Zealand residents. Once accepted, this Agreement replaces any earlier terms on the Casino Website, and a player who registers is taken to have read, understood and accepted all that follows.

Definitions

A handful of terms carry specific meanings throughout this Agreement:

  •  «Account» — the unique account the Casino issues to a player; the «Casino» is the casino at the Casino Website, owned or operated by the Operator, and the «Casino Group» is every online casino it owns, Baytree among them.
  • «Charge-back» — a reversal of charges on a card or third-party deposit, triggered by the player, an issuing bank or a payment provider.
  • «Inactive Account» — an account with no login or logout recorded for more than six consecutive months.
  • «Guest Player» plays with free credits of no monetary value, while a «Real Player» has registered an account.
  • «Payment Service Provider» — a third party engaged to process money transfers; «Software» — any program owned by or licensed to the Operator that enables play, including no-download Flash versions.
  • «Player’s Jurisdiction» — the place where the player is domiciled, lives or works

The Operator and Its Licence

The Operator behind the Casino is Baytree Interactive Ltd (company number 69691), a Guernsey company registered at Ground Floor, Kingsway House, Havilland Street, St Peter Port, Guernsey, with its group companies, and is authorised and licensed by the Kahnawake Gaming Commission under licence number 00892, issued on 16 February 2022. Every transaction between a player and the Operator takes place in Canada, where the principal servers sit, and the player’s gaming contract is with Baytree Interactive Ltd, which supplies the gaming services.

1. Participation at the Casino

Taking part is the player’s own choice and risk. As online gambling is unlawful in some territories, each player must confirm that play is permitted where they are located before relying on anything shown on the Website; the Casino does not help anyone breach local law and disclaims, as far as the law allows, liability for use of the site. Accounts, bets and transactions cannot be opened or processed for residents of a long list of restricted territories — Australia, the United States, the United Kingdom and Ontario among them — and that list may be revised at the Operator’s discretion.

Registration is open only to applicants aged 18 or above who have also reached the age of majority where they live, and proof of age may be sought, with the account held until acceptable documents arrive. The Operator gives no warranty as to the legality of participation, may require proof of identity and age before play, and asks that all registration details be accurate and complete; each player authorises checks on their identity and right to use the funds wagered. Further conditions apply:

  • The number of accounts is limited, at the Operator’s discretion, to one per brand; funds or credits may not move between accounts held by the same person or by third parties, winnings may be paid in Euros, whatever currency applies, and balances earn no interest.
  • Account details may be verified at any time, with the account suspended pending verification; contact information should be kept current, communications from the Group and its marketing agents are accepted on registration, and play on credit is not permitted.
  • A player chooses a username and password, must keep them secret and is answerable for any activity, including financial losses, carried out once they are entered correctly; the Operator is not liable where an account is compromised through weak or shared passwords, and offensive usernames may lead to closure.
  • Offers are restricted to one per person, family, household, address, email, telephone number, card and shared computer, are meant for recreational players, and may be limited or withdrawn at the Operator’s discretion.
  • Bonuses and winnings can be reclaimed where a player is found tampering with or abusing a promotion, and bets engineered to guarantee a profit through promotional offers may be settled at correct odds with the bonus element disregarded.

2. Player Warranties

On entering this Agreement and throughout, each player warrants that they may lawfully take part where they live; have reached the age of majority; will let no third party, least of all a minor, use their account, the Software or any prize; have given valid, complete details and will report changes promptly; lawfully own or are authorised to use the funds wagered; will not stake money from illegal activity; will pay sums owed and not charge back or reverse payments; have read and understood these terms; and play individually for personal entertainment, not professionally or with others. A breach voids the player’s transactions and forfeits any winnings from them.

3. Refusal, Deregistration, Exclusion and Suspension

The Operator may decline to register a player, or deregister, exclude or suspend one, at any time, on written notice with reasons. A player affected may complain to eCOGRA or to the Kahnawake Gaming Commission, the regulating body. Where no complaint reaches the regulator within thirty days, the Operator may withhold contested funds, bar the player from other group casinos, set the terms for any new account, and — in cases of fraud, illegality or unpaid sums — record the conduct on an intra-group database, pass details to a collections agency and treat fraudulently derived funds as forfeited. Where a complaint is lodged in time, contested funds are withheld only if the regulator so directs.

4. Inactive Accounts and Dormant Bonuses

These provisions apply only when all of a real player’s Casino Group accounts are inactive. A credit balance in such an account may, at the Operator’s discretion, attract a €10 monthly administration fee over an eighteen-month span, after which any remainder is forfeited — the charge stopping once the balance reaches zero or the account becomes active. Separately, bonuses and their winnings may be lost if left unused for six months from the award date, loyalty points count as bonuses.

5. Money Laundering

Strict anti-money-laundering laws in some jurisdictions may oblige the Operator to report a player to the authorities where it knows or suspects that transactions involve or conceal funds from illegal activity. On such a suspicion, it may suspend, deregister or terminate the account, refuse to refund the funds in it, exclude the player from other group casinos and log the conduct on an intra-group database. To deter laundering, no cash funds are accepted, and large or unusual withdrawals are released only once notarised copies of a recent bank statement, a government photo ID and a utility bill under six months old are received.

6. Publicity and Consent

A player who wins the Casino judges newsworthy agrees to take part in related publicity, with privacy protected as far as possible, and the Casino may use the player’s first name and a model’s image in its place. Calls may be recorded or monitored for quality and security, and use of the service counts as consent; internet communications, transaction details and visit records may also be stored. Registering a practice or real account permits contact by email, telephone or SMS on account matters, and unsubscribing from promotional material still leaves service messages in place.

7. Bots and Prohibited Software

Using or abusing bugs, bots or any form of artificial intelligence within the Software or Services is prohibited, as is software meant to influence game outcomes for gain; money obtained this way is deducted from the player’s funds. Where such conduct is detected, the Operator may block the account, freeze the funds and reserve the right to pursue legal proceedings.

8. The Service

The Software and Services come «as is», with no warranty — express or implied — as to merchantability, fitness, completeness or accuracy, and the full risk of use rests with the player. The Casino is not liable for downtime, server disruption, lag, connectivity faults or the acts of an internet provider or other third party used to reach the host server, and does not warrant uninterrupted, secure, error-free or virus-free operation. Errors affecting random-number generation or bet settlement, and any malfunction of the Website or the player’s equipment, void the bets, pays and plays concerned, and winnings from such errors may be voided with accounts closed where the errors are abused. Wagers count only once the server accepts them; the Operator may refuse or limit any wager, and the Service may be suspended in whole or part at any time. Players handle their own taxes on winnings; the Casino gives no tax or legal advice, and currency-exchange arbitrage is forbidden, with any gains forfeited. The Software may be used only under these terms and Apricot’s End User Licence Agreement; copying, reverse-engineering, modifying, selling, sublicensing, distributing or exporting it is prohibited, and the player bears any resulting harm.

9. Shared Environments

Where accounts originate from settings in which computers, or the environment itself, are shared, the Operator may impose whatever limits or conditions it considers appropriate on those who open or try to open accounts.

10. Indemnity and Limitation of Liability

Use of the Services is the player’s own choice and risk. The player indemnifies the Casino, its directors, officers, employees, shareholders, agents, affiliates and parent and subsidiary companies against all costs, liabilities and damages — direct or indirect — arising from their participation. Those parties are in no circumstances liable, in contract, tort, negligence or otherwise, for any loss, however caused, even where the possibility was notified. After a transfer to the Payment Service Provider is confirmed, the Operator is not liable for loss from a failed or delayed payment, nor for the acts of third-party advertisers; nothing, however, excludes liability for fraud or for death or personal injury caused by the Company’s negligence.

11. Promotions, Competitions and the Cash-Back Programme

The Casino runs promotions, competitions and a cash-back programme from time to time, each able to carry its own specific terms, which prevail over these general terms to the extent of any conflict. Promotions may be limited, excluded or ended at the Casino’s discretion without notice, and unused bonuses, their winnings and issued loyalty points lapse six months after issue, even where play-through is met. The cash-back programme runs at the discretion of the company and may be withdrawn without notice.

A player who has already claimed a sign-up bonus at another Casino Group brand cannot claim one again until the earlier bonus and deposit have been wagered at least one hundred times, and only one sign-up bonus is available, even across several accounts; an ineligible one, with its winnings, may be voided retrospectively. Bonus funds carry a wagering requirement of at least seventy times before moving to the cash balance — so a €100 deposit plus a €100 bonus implies €7,000 of play-through — varying by game, promotion and region. No-deposit and free-spin winnings carry the same 70x rule, with any positive cash balance on completion capped at 100 casino credits. An untouched bonus may be reversed via live chat; once part-used, it stays until the requirement is met, and with a sign-up bonus, withdrawals are limited to six times the first deposit, progressive wins excepted.

Before a withdrawal is processed, play is reviewed for irregular patterns: equal, zero or low-margin bets and hedge betting count as irregular, as do single bets of 30% or more of the credited bonus before the requirement is met. The Casino decides what counts as irregular play and may deny, withhold or withdraw a bonus, block an account or end access where abuse or bad faith is suspected, refunding only original deposits.

12. Rules of Play

Specific Rules of Play and FAQs apply alongside these terms and bind the player as if written in. A payout left in play on video poker may be collected and credited back, funds left in play on any other game for ninety days or more may be confiscated, and winnings may also be confiscated where a player has self-excluded elsewhere over gambling problems.

13. Payments and Withdrawals

Verification documents may be requested on registration or before any transaction — proof of income where relevant, photo ID, proof of residence under six months old, and proof of ownership of any payment method — and an account may end if they are not supplied. The Operator may run third-party credit checks, settle outstanding charge-backs from any Cityviews-powered casino on withdrawal, and pay only to the registered name, with card deposits matched to the card name and the deposit method reused up to the deposited amount. Identity is verified for single or cumulative transactions of €2,000 or more. 14. Responsible Gaming

Gaming should be enjoyable but can become addictive, so the Operator supports responsible play by blocking or suspending accounts on request and by pointing players to support staff and to the Responsible Gaming page, where the Group’s self-exclusion policy sits. Email requests are actioned within a reasonable time, though slight delays may occur, and the Casino is not liable for losses during pending communications; urgent matters should go through live chat.

15. Intellectual Property

The Operator grants a revocable, non-exclusive, non-transferable right to use the Casino Website and Software and their content with the Service, in line with these terms. All copyright, trademarks and other intellectual property stay vested in the Operator or its licensors; the material is for personal, non-commercial use, may be stored on a single hard drive only, and copying, distributing, exploiting or creating derivative works from it is prohibited.

16. General Provisions

The Operator may change these terms, promotion-specific terms or Rules of Play at any time without notice, effective once posted, and players should review the pages regularly. The Casino’s employees, subsidiaries and affiliates, and the immediate family of such individuals, may not take part as real players. Any part found unlawful or unenforceable is severed and amended to reflect the original intent as far as the law allows, without affecting the rest. No indulgence waives the Casino’s rights, and nothing confers rights on a non-party. Acceptance acknowledges that gambling risks losing money, for which the player alone is responsible, with no claim against the Casino or its partners. The terms form the whole agreement and supersede earlier understandings.

The Casino is regulated under the gaming legislation of the Mohawk Territory of Kahnawake, and the Agreement is governed by that territory’s laws, subject to the non-exclusive jurisdiction of its superior courts. Information about a player and their account may be disclosed to the Kahnawake Gaming Commission. Any claim must be brought within six months of its cause, after which it is waived, and where translations differ the English version prevails. Tournament entry is one per person, account, shared environment and email, with a single alias, and free-roll winnings before a cash deposit are capped at 100 casino credits on withdrawal.

A formal complaint is made by emailing [email protected] — the only valid address — within six months of the issue, with the username or account number, full name, a detailed explanation and any evidence. Customers then have four weeks to reply, failing which it is treated as resolved, and none may be logged within a week of a withdrawal. If unresolved internally, it goes to the approved independent ADR provider, eCOGRA, which needs a valid dispute reference number; remaining dissatisfaction may be escalated to the Kahnawake Gaming Commission with that reference and the related correspondence.

These terms are personal and cannot be assigned without consent, while the Operator may assign its rights and obligations to a third party without notice. On a change of control, merger, acquisition or asset sale, a player account and its data may pass to the purchaser, with notice of the options then available. The Operator may cancel an account at any time without notice, crediting any balance, yet may void winnings and confiscate a balance for, among other things, holding multiple accounts, a name mismatch with the deposit card, cashing in a promotion early, false registration data, being under age or in a banned jurisdiction, letting another play the account, professional or collusive play, charge-backs, or cheating, money laundering or fraud. An account is closed by contacting Player Services.

Where the result on the player’s software differs from the result on the server, the server result governs. The Casino is not liable for any failure or delay caused by events beyond its reasonable control, and nothing in the terms creates an agency, partnership or joint venture between the player and the Operator.

17. Mobile Casino

On the Mobile Casino, further terms apply. The player alone bears any connection, usage or other charges levied by their network operator when registering, downloading the Software, betting or communicating, and these form no part of any bet. The player is likewise responsible for the devices, networks, internet access and permissions needed to use the Casino, and must not access the Service while roaming where gambling is forbidden.
